Are train horns legal in South Dakota?
Installing an aftermarket train horn on a private vehicle in South Dakota is not prohibited. SD train horn law is split across two sections. SDCL §32-15-10 requires every motor vehicle to carry a horn audible at 200 ft (a violation is a petty offense). SDCL §32-15-11 is the use-and-equipment rule: it makes it a Class 2 misdemeanor to equip or use a siren, a compression or spark plug whistle, an exhaust horn, or a whistle “which does not produce a harmonious sound,” to use a horn “otherwise than a reasonable warning,” or to make any “unnecessary or unreasonably loud or harsh sound” with a horn. Emergency vehicles are covered by §32-15-12.
Install is legal; use on SD public roads — Sioux Falls, Rapid City, Aberdeen, Brookings, Watertown — is the regulated behavior.
What SDCL §32-15-10 and §32-15-11 actually say
Every motor vehicle when operated upon a highway shall be equipped with a horn in good working order capable of emitting sound audible under normal conditions from a distance of at least two hundred feet. A violation of this section is a petty offense.
It is a Class 2 misdemeanor, except as otherwise provided in § 32-15-12, for any vehicle to be equipped with or for any person to use upon a vehicle any siren, or any compression or spark plug whistle, or any exhaust horn, or whistle which does not produce a harmonious sound, or for any person at any time to use a horn otherwise than a reasonable warning or to make any unnecessary or unreasonably loud or harsh sound by means of a horn or other warning device.
Operative rules: 200-ft audibility (§32-15-10) · horn use only as a reasonable warning · no unnecessary or unreasonably loud or harsh sound · no siren, compression/spark plug whistle, exhaust horn, or non-harmonious whistle (§32-15-11).
Updated 10/10/2026: an earlier version of this page quoted a paraphrase as the text of §32-15-10. Per the official SD Legislature text, §32-15-10 contains only the horn-and-audibility requirement; the “unreasonably loud or harsh” and reasonable-warning rules are in §32-15-11. Both sections are now quoted verbatim. The overall conclusion (install not banned, use regulated) is unchanged.
Does the factory horn need to stay working in SD?
Yes. §32-15-10 applies to the vehicle as a whole.
Is a train horn a “whistle” or “exhaust horn” under SDCL?

- ·Emergency vehicles: §32-15-12
- ·Compressed-air horn, not exhaust-driven

- ·Factory horn must remain functional
Portable and battery-powered train horns in SD
§32-15-11 regulates the use of “a horn or other warning device” regardless of power source. M18, DeWalt 20V, Ryobi, Makita portables fall under the same rules.
Enforcement in practice
Note that an exhaust-driven horn or whistle is expressly listed in §32-15-11, so this page’s “legal” status covers compressed-air train horns only.
South Dakota is broadly permissive. Sioux Falls and Rapid City see complaint-driven enforcement; rural counties and West River rarely cite.
Practical SD train horn compliance
- 01 Keep factory horn wired and functional
200-ft rule applies to the vehicle.
- 02 Put the train horn on a separate switch
Distinct from OEM button.
- 03 Use factory horn for ordinary signaling
Reasonable-warning limit per §32-15-11.
- 04 Reserve use for off-road / farms / private property
SD has substantial ranch and agricultural land.
- 05 Watch Sioux Falls / Rapid City ordinances
Municipal noise codes apply.
- 06 Hearing protection when testing
140+ dB causes immediate damage.
